The Food Safety Compliance System (FoSCoS) has replaced the Food Licensing and Registration System (FLRS), which was established in 2012 for the issue of FSSAI Licenses and Registration throughout India.

WHO MUST APPLY FOR AN FSSAI LICENSE APPLICATION?
Everyone working in the food sector, including small-scale sellers and large-scale chains, must register with the FSSAI. You must register with the FSSAI regardless of whether you operate online or offline, or a local player, or involved in importing or exporting food items. You must get one of the three types of registration or licenses, depending on your size and the locations where you operate.
A food license is required for you if your company fits into any of the following categories:
- Procurement
- Manufacture
- Distribution
- Processing

In other words, a person or a business dealing with food ingredients from farm to plate needs an FSSAI food license.
TYPES OF FSSAI
INDIA'S FSSAI FOOD LICENSE TYPES
Basic Online Food License Registration
It is the most common type of registration given out to companies with minor annual sales up to about 12 lakhs. Regardless of their annual revenue, catering enterprises must apply for a state license rather than just a basic FSSAI registration.
State FSSAI License
An FSSAI state license is required for businesses with profits of more than Rs.12 lakhs.
Central FSSAI License
Businesses with a revenue of over 20 crores per year are eligible for central registration. Companies that operate franchises or chains of hotels or restaurants, import or export food, an internet platform, or offer food to government agencies must obtain a Central FSSAI license.

REGISTRATION OF RENEWAL
RENEWAL OF FSSAI REGISTRATION / LICENSE
- A license or registration renewal application must be submitted no later than 30 days before the license or registration expires.
- Until the decision is made on the renewal application, which cannot happen more than 30 days after the registration or license's expiration date, the registration or license shall remain in effect.
- Any renewal application submitted outside of the aforementioned timeframe but before the expiration date must be accompanied by a Rs.100 per day late fee.
- If a renewal application is not submitted, the license expires and the food company operator must shut down operations.
- The Food Business Operator must apply for a new registration or license if they want to relaunch their business.
CANCELLATION OF FSSAI
SUSPENSION/CANCELLATION OF FSSAI LICENSE
- If there is reason to suspect that the Food Business Operator has not complied with the requirements within the time frame specified in any Improvement Notice delivered under Section 32, the registering or licensing authority may suspend any registration or license at any time.
- If a Food Business Operator continues to violate the terms of the authority's improvement notice within the allotted time frame, the registering authority may cancel the license or registration.
- If all of the improvements listed in the improvement notice have been made, the Food Business Operator may submit a new application for registration or a license 3 months after the date of cancellation.
REGISTRATION TRANSFER
TRANSFER OF LICENSE / REGISTRATION IN THE EVENT OF DEATH
In the event that the holder of a Registration certificate or license passes away, the certificate or license shall continue to be valid for the benefit of the legal representative or any surviving family members until the earlier of:
- The period of 90 days following the date of the holder's passing.
- The longer period that the Designated Officer may permit, for reasons to be recorded in writing (or)
- The concerned Authority must receive an application from the holder's legal representative or a member of their family asking for the transfer of the certificate or license in their behalf.
FEES FSSAI
ONLINE FSSAI FEES PAYMENT
The applicant or FBO is required to pay the necessary fees while completing the FSSAI registration form. The corresponding FSSAI registration fees for the various categories of registrations are as follows:
- FSSAI basic registration – Rs.100.
- FSSAI Central License: Rs.7,500.
- The FSSAI State License costs between Rs.2,500 and Rs.5,000 (Depending on the type of business carried out)
Penalty for Failure to Register
If a food business operator (FBO) operates their business without registering with the FSSAI, they may be sentenced to prison and/or pay a licensing penalty of up to 5 lakhs.
Required Documents for FSSAI Registration
You must submit certain documents needed for FSSAI Registration depending on the sort of registration you are submitting for and the type of food business you are operating.
FSSAI Registration License
- Self-Attested Passport-sized photo of the authorized individual.
- Self-Attested Front and back of Aadhar card.
- Address documentation for the business location (rental agreement, last month's electricity bill, or landlord's NOC).
- Signed Declaration by the authorized person.
Central & State License
- Passport-sized photo of the owner, partners, or directors.
- Directors, partners, and owners' identification documents (Aadhar and PAN Cards).
- Address Evidence of the business location (rental agreement, last month's electricity bill, landlord's NOC).

- The sketch of the property.
- List of the company's food products on letterhead [with seal and signature] .

Renewal or Transfer or Modification of FSSAI License
- Any change in documents or information provided during grant of previous license.
- Certificate or Plan of Food Safety Management System.
- List of Nominee details (If changed) workers with their medical fitness certificates.

FSSAI license is based on the premise. All food business activities conducted at the same premise can be applied for a single FSSAI license.
A food business operator must promptly halt operations when their license or registration has been suspended or cancelled. Under the FSS Act of 2006, engaging in any food business activity while operating under a suspended or revoked license or registration is illegal and subject to penalties.
After three months from the date of cancellation under Regulation 2.1.8 (3), the FBO may make a new application for License to the concerned authority if all observations that were made in the improvement notice have been complied with.
No. FSSAI vide order number 03-01/2012/Enf-I/FSSAI dated 21st January 2015 exempted individual members from obtaining FSSAI registration certificates. They must adhere to all of the requirements outlined in the order and be a registered member of the society that is licensed or registered with FSSAI.
You must apply online by logging into the Food Safety Compliance System (FoSCoS) account from which the license or registration application was submitted in order to surrender the license or registration. It will be regarded as surrendered following authorization from the relevant authority.
The following penalties apply to renewing the FSSAI License/Registration even beyond the expiration date for Food Business Operators: A. From the first to the 90th day following the initial expiration date, pay three times the current yearly license/registration price. B. From the 91st to the 180th day after the initial expiration date, an additional two times the current annual license/registration fee (i.e., five times). Refer to FSSAI Order 15(31)2020/FoSCoS/RCD/FSSAIpt4 from October 29, 2021.
An FBO must obtain a Central License for his Registered Office or Head Office in addition to the registration or license for each unit or premises if he has food business locations in two or more States. Depending on the capacity or turnover of each unit or premises, a separate license or registration must be obtained from the relevant Central or State licensing authorities. Additionally, if any food business activity is carried out on the grounds of the registered office or head office, that activity must also be included in the head office license.
I have manufacturing units in multiple states. Will I be required to get a standard license for the company or an individual permit for each team?
For every manufacturing unit, specifically State/UT, you will need to obtain a separate Central or State license or Registration Certificate (as per the qualifying criteria of respective units). You will also need to obtain a Central License for your company's Head Office/Registered Office.
Through FSSAI, A user ID based on a license, registration, or application number was introduced with Order Number 15(31)2020/FoSCoS/RCD/FSSAI dated 25th November 2021. Additionally, users can apply to their area officers in accordance with the SOP [Annexure- II] attached to the order to amend the credentials [email address and cellphone number] linked to the license/registration or application.
A platform does not need to obtain an FSSAI license if it just lists FBOs and does not carry out any of the activities listed in Section 3(n) of the FSS Act, 2006. Only FBOs with active FSSAI licenses or registrations, though, may be listed.
